1. Acceptance of Terms
By downloading, installing, accessing, or using the Check-On-Me application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must discontinue use of the App immediately.
2. Description of Service
Check-On-Me is a subscription-based digital notification and check-in application.
The App allows users to:
- Perform a daily check-in via the App
- Designate a carer (email recipient)
- Trigger automated email notifications if a check-in is missed within a configured period
Important: The App is a notification and notification service only and does not provide emergency, medical, healthcare, safety monitoring, or security services.
3. No Emergency or Medical Service
You acknowledge and agree that:
- The App is not an emergency response system
- It does not contact emergency services (e.g., police, ambulance, fire department)
- It does not provide medical advice or monitoring
- It should not be relied upon as the sole means of safety, health, or welfare monitoring
Users and Carers are solely responsible for taking appropriate action in any emergency situation.
4. User Responsibilities
You agree that:
- All information provided (including Carer email addresses) is accurate and up to date
- You are responsible for ensuring your device, internet connection, and notifications are functioning
- You will perform daily check-ins as required
- You understand that failure to check in may trigger automated notifications to Carer
- You will not misuse the App or rely on it for life-critical monitoring
5. Trial run, Subscription, Billing, and Refunds
- The App operates on a paid subscription model. A free trial run is offered for you to try out the app before you subscribe.
- Subscription fees are charged in advance and may renew automatically unless cancelled.
- You are responsible for managing your subscription through the relevant app store (Google Play).
- Refunds are subject to Google Play refund policies and applicable law.
- Non-payment or failed renewal may result in suspension or loss of access to services.
6. Google Play Billing Compliance
Where applicable:
- All purchases are processed through Google Play Billing
- Subscription terms, pricing, and renewal conditions are clearly displayed prior to purchase
- Users may cancel subscriptions via Google Play account settings
7. Data Accuracy and Notification Limitations
You acknowledge that:
- The App processes user check-in at a fixed time every day and thus, missed check-in may take up to 48 hours before it is detected in certain edge cases.
- The App depends on user-provided data for Carer notifications.
- Incorrect or outdated email addresses may result in failed notifications.
- Email delivery is dependent on third-party providers and is not guaranteed.
- Emails may be delayed, filtered as spam, or not delivered due to external factors.
The Developer does not guarantee real-time delivery or receipt of notifications.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Developer shall not be liable for any loss, injury, damage, or harm arising from use or inability to use the App
- This includes (without limitation) direct, indirect, incidental, consequential, or punitive damages
- This includes loss of life, health outcomes, emotional distress, financial loss, or reliance on missed or delayed notifications
- The App is provided on an "as is" and "as available" basis
You acknowledge that reliance on the App is at your own risk.
9. Third-Party Services
The App relies on third-party services including:
- Email delivery providers
- Cloud hosting infrastructure
- Google Play services and billing system
The Developer is not responsible for disruptions, delays, or failures caused by third-party systems.
10. Acceptable Use
You agree not to:
- Use the App for unlawful, fraudulent, or abusive purposes
- Interfere with or disrupt App functionality or infrastructure
- Attempt reverse engineering, hacking, or unauthorized access
- Provide false or misleading information intentionally
11. Service Availability
We do not guarantee uninterrupted or error-free operation of the App. Maintenance, updates, technical issues, or third-party failures may result in temporary service interruption.
12. Termination
We may suspend or terminate access to the App at any time if:
- You breach these Terms
- Fraudulent or abusive usage is detected
- Required by law or regulatory authorities
You may stop using the App and cancel your subscription at any time.
13. Privacy and PDPA Compliance (Malaysia)
We are committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
13.1 Personal Data Collected
We may collect and process the following:
- Name and account details
- Email addresses (including Carer email addresses)
- Device and usage information (for app functionality and analytics)
- Subscription and payment status (processed via Google Play)
13.2 Purpose of Data Use
Your personal data is used strictly for:
- Providing and operating the App's core check-in and notification features
- Sending automated email alerts to designated Carers
- Managing subscriptions and account access
- Improving App performance and reliability
13.3 Consent
By using the App, you explicitly consent to:
- The collection, use, and processing of your personal data
- The sending of automated emails with your contact information and personal messages to designated Carers on your behalf
- Data processing as required for service functionality
13.4 Disclosure of Data
We do not sell personal data. However, data may be shared with:
- Email service providers (for notification delivery)
- Cloud infrastructure providers
- Payment processors (via Google Play)
Data is only shared to the extent necessary for service operation.
13.5 Data Retention
We retain personal data only as long as necessary to:
- Provide App services
- Comply with legal obligations
- Resolve disputes or enforce agreements
You may request deletion of your account and data (subject to legal and operational requirements).
13.6 Data Security
We implement reasonable technical and organizational safeguards to protect personal data. However, no system can guarantee absolute security.
13.7 User Rights (PDPA)
You have the right to:
- Access your personal data
- Request correction of inaccurate data
- Withdraw consent (which may affect App functionality)
- Request deletion of your account and associated data

14. Changes to Terms
We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Malaysia.
